One of the sticking points in the Madoff case is related to the flow of information regarding the value of Madoff fund assets. "The biggest challenge for a custodian is to make sure the assets are properly valued. If there is a lack of transparency, it would certainly make the custodian's job a lot more difficult in getting accurate information on behalf of the client," said John Giudice of Buttonwood International Inc., a New York consulting firm.
